  1. The Gift Card is not covered by the Payment Services Rules 2009 or the Electronic Payment Rules 2011. The purchase of a Gift Card is the purchase of a means of payment, not a deposit. No interest is accumulated on the amount available on the card.
  2. The card and the available balance are valid for a period of 12 months from the date of purchase (or from the date on which payment is made for the card, in the case of Internet purchases). Your Gift Card will cease to be valid 12 months after the date of purchase. After that date, you will not be authorised to use it.
  3. If the card was purchased from the shopping centre management, the maximum value the card can be loaded with is €1000. If purchased at the shopping centre’s InfoPADs, the maximum value the Gift Card can be loaded with is €400. A Gift Card which has been purchased at the Shopping Centre will already be active and the value on the Gift Card will be available for use within an hour after purchase.
  4. Further funds may not be loaded onto the Gift Card after the initial purchase, except if a shop refunds a transaction on the card. You may have to wait a few days for a refund.
  5. Two or more Gift Cards in your possession for the same shopping centre can be combined into a single gift card. To do this, please contact the management of the Grand’Affi Shopping Centre. This procedure is subject to an administrative fee of €1.00 for the first two cards and a surcharge of €0.20 for each additional card. This cost can be deducted from the available balance on the cards.
  6. Before issuing the Gift Card, a check of your identity may be required. This information is necessary for the prevention of fraud and to combat money laundering. Moreover, this information can help us if your card is lost or stolen. We retain this information only as long as it is necessary and for the purposes described.

HOW TO USE THE GIFT CARD

  1. The Gift Card may be used by the purchaser of the Card or may be given as a gift to another person. The Gift Card is a bearer card.
  2. We reserve the right to assume that a transaction has been authorised by you where the magnetic stripe of the card has been swiped by the shopkeeper, where there is a signed receipt or where information has been provided to the shopkeeper enabling them, to proceed with the transaction. We normally receive notification of your authorisation via an electronic message in line with the rules and procedures of the payment system circuit.
  3. Upon receipt of instructions to proceed with the transaction, the transaction may no longer be stopped or revoked.
  4. The Gift Card can be used for the full or partial payment of purchases. In the case of partial payment, the person using the Gift Card will have to pay the difference by an alternative means, e.g. cash or debit or credit card.

RESTRICTIONS ON THE USE OF THE GIFT CARD

  1. The Gift Card can only be used for payment within a limited circuit of shops within the Shopping Centre. You may not use or attempt to use the Gift Card outside the circuit of that Shopping Centre.
  2. The Gift Card cannot be reloaded further after purchase.
  3. The Gift Card cannot be used to withdraw cash at ATMs or banks. The Card is not designed to be used for mail order, Internet, or other transactions which are not ‘face-to-face’.
  4. The Gift Card is not linked to a bank account and is not a guarantee card, nor is it a debit or credit card, nor can it generate interest on the available balance, nor can it be used as proof of identity.
  5. The Gift Card may not be used for regular pre-authorised payments, for gambling, or for illegal purposes.
  6. The use of the Gift Card may be restricted without notice if suspicious, fraudulent or illegal activities are identified, or if we believe that these ‘Terms and Conditions’ have not been complied with, or in the event of exceptional circumstances which prohibit the normal use of the card.

 

8. GIFT CARD EXPIRY AND RIGHT OF REFUND

8.1. Your Gift Card will cease to be valid 12 months after the date of activation. This date is defined as the ‘expiry date’. On that date, the Card will cease to function and you will not be entitled to use it. The available balance on the card (if any) on the expiry date will be retained by us; please use the total amount of the card before its expiry date. Any funds withheld will be used for the administration of the Gift Card programme.

8.2. For a period of 90 days from the expiry date, you will be entitled to reactivate the same Gift Card for another 3 months by incurring an administrative fee of €9.95 and declaring that you are the rightful owner of the Gift Card. We may ask you to provide proof of identification to confirm ownership of the Gift Card prior to reactivation, e.g. by providing a copy of the Gift Card, and requesting your ID card.

RIGHT OF WITHDRAWAL AND REFUND PROCEDURE

  1. Only the person who purchased the Gift Card may request a refund, subject to proof of identity, presentation of the original sales receipt and return of the Gift Card. Any refund shall be made by returning the funds to the original source of purchase of the Gift Card; for example, if the Gift Card was purchased with a credit card, the funds shall be returned to the same credit card. Sufficient proof of purchase will be required before a refund will be authorised.
  2. The card purchaser is entitled to a period of 14 days to withdraw from this agreement. If you wish to cancel the Gift Card, please return it unused and with the original sales receipt within 14 days of purchase to the Shopping Centre Management or, alternatively, via the toll-free number 800.141.736.
  3. After 14 days from the date of purchase, only the amount available on the Gift Card will be reimbursed and the reimbursement will be subject to an administration fee of €9.95 to cover the costs of preparing the reimbursement and the subsequent cancellation of the Card.
  4. Should you request a refund of the amount available on the Gift Card in accordance with the conditions set out in clauses 9.2 or 9.3, we shall interpret this request as your withdrawal from this Agreement and reserve the right to retain the Gift Card.

KEEPING YOUR DATA AND YOUR GIFT CARD SAFE

  1. You must keep your Gift Card and the data it contains safe. This means that all reasonable measures must be taken to prevent the loss, theft or misuse of the card. Do not disclose Gift Card data to anyone except those who are necessary to complete a transaction. You should make sure that the shopkeeper or service provider is genuine and has taken adequate measures to safeguard your information before proceeding with the transaction, or before providing them with your Card details.

LOSS, THEFT OR DAMAGE OF THE GIFTCARD

  1. If you lose your Gift Card or if it is stolen or damaged, please notify CENTRO SERVIZI SRL immediately by calling the Customer Service Department. You will be asked to provide your Gift Card number and other information to verify that you are the authorised cardholder. Following the satisfactory completion of the verification process, CENTRO SERVIZI SRL shall immediately block any lost or stolen Gift Card to prevent its unauthorised use and cancel any damaged Gift Card to prevent its further use.
  2. If we believe that you have acted fraudulently or have – intentionally or due to gross negligence – failed to keep your card and/or data and its security features safe, you shall be held liable for all transactions. We can limit your liability to a maximum of €50 per lost or stolen Gift Card before you notify our customer service of the theft or loss; however, it is important that you contact us as soon as possible in the event of this happening. If we believe that you have delayed notifying us or have acted negligently, you may be held liable for the full amount.
  3. Once you have informed us of the loss, theft or damage of your gift card and if we are able to identify your card and meet the security checks, you will be able to obtain a replacement card at the Grand’Affi Shopping Centre, in accordance with the instructions provided by our customer service team. The sum of €5.95 shall be deducted from your remaining balance as a cancellation and replacement fee for the amount available on the Gift Card, or you may choose to pay this fee separately. Replacement cards may not be withdrawn after the expiry date of the original card. The replacement card shall be valid for a period of 12 months from the date you collect the card. The right of withdrawal does not apply to replacement cards.

PURCHASES FROM SHOPKEEPERS AND TRANSACTION DISPUTES

  1. We are not responsible for the safety, legitimacy, quality or any other aspect of the goods and services purchased with the Gift Card.
  2. If you believe that you have not authorised a particular transaction, or if you have any dispute about the goods or services purchased, you should contact the Customer Service Department by calling 800.141.736.
  3. If you identify a transaction which you believe was not authorised by you or was incorrectly executed, you must inform us without undue delay and in any event no more than 13 months from the date of the transaction. If we believe that you have failed to inform us without undue delay, we will not be able to help you with such a dispute.
  4. If we believe that you have acted fraudulently or with gross negligence based on the evidence then available to us, we shall investigate the circumstances of the case and may refuse to refund the value of an unauthorised or incorrectly executed transaction until we have completed our investigation and are satisfied that you are entitled to compensation.
  5. If you have notified us of an unauthorised or incorrectly executed transaction in due time and you have not acted fraudulently or with gross negligence, we shall have the Gift Card reinstated as if the unauthorised or incorrectly executed transaction had never taken place.
  6. In some cases a transaction may be initiated but not completed. If this happens, it may be the case that the amount of the transaction is deducted from the available balance on the Gift Card and is therefore not available for use – this is referred to as ‘suspended’ or ‘blocked’ authorisation. In such cases, you must contact our Customer Service Department and present relevant evidence to prove that the transaction has been cancelled or refunded; in the absence of sufficient proof, we reserve the right to impose a waiting period of 5 working days before reloading the blocked amount onto your card.
  7. In cases where a shopkeeper offers a refund for any reason (e.g. if you return the goods as defective), it will take several days for notification of the return and for it to become available. Therefore, please allow 5-10 days from the date of the refund for the refunded amount to be available on your Gift Card.

CUSTOMER SERVICE

  1. All telephone enquiries relating to the Gift Card must be made to the Customer Service Department by calling 800.141.736 or by writing to Customer Service, Centro Servizi S.r.l. Via E. Curiel, 17 – 20060 Liscate (MI). The Customer Service team is available from 9am to 9pm, Monday to Sunday. During these hours we shall endeavour to resolve all requests immediately, but please note that some requests can only be fulfilled during normal office hours.
  2. Our normal office hours are Monday to Friday, 9am to 6pm. Correspondence received after the close of business on a given day shall be treated as having arrived at the beginning of the next business day.
  3. For any complaints concerning your Gift Card you should, in the first instance, contact us using the contact details above, stating and explaining the reason for your dissatisfaction. We will register your complaint and investigate it in accordance with our Internal Complaints Procedure; once the investigation has been carried out, we shall send a conclusive response to the complaint in writing.

PERSONAL DATA

  1. We collect certain information about the purchaser and Gift Card users for the purpose of administering the Gift Card programme. In order to collect personal information, Gift Card Aziendali acts as a Data Controller, as described in the Data Protection Act of 1998.

Flex-e-Card Ltd is registered in the ICO Data Controllers Register.

  1. Your personal data shall be processed by all the organisations described, for the purpose of managing the Gift Card and to deal with any enquiries about the Gift Card. In order to provide customer service and manage your account, we can use the assistance of data processors and can transfer data outside the EEC. If we do so, we will take steps to ensure that the data are subject to the same level of protection as if they had been processed within the EEC.
  2. Unless you have given us your consent, your personal data will not be used for marketing purposes, nor will they be shared with third parties outside the Gift Card programme.
  3. By purchasing or using the Gift Card, you accept all the terms and conditions of this document regarding the use of your personal information. You have the right to request details of your personal information held by us, and you may receive them by writing to Centro Servizi S.r.l. Via E. Curiel, 17 – 20060 Liscate (MI).
